I don't know who has what license, but what you say makes sense.
That said, as much as I love this HT 1/4 Bat, I would go nuts it if EB took a shot at TDK Batsuit! I would make room for both.
Ledger was a game-changer and an oscar winner, but, call me crazy, I still preferred Hardy's BANE. And Bane would be an awesome 1/4 scale in that coat.
With all the sold-out presales, this Batman figure is going to be a big hit of HT and I do think we will get a 1/4 Ledger. Is like guaranteed...

Different camera lenses are used for different distances.
Batman in close up was almost always shot by Pfister with a wider lens...slims the neck and the width of the cowl but bumps up the size of the nose a touch.
Look at that close up where he says "Bane", in the sewer...
The shape of the EB cowl, you mean? I think it looks great.
And the likeness "under" the cowl is quite good, especially at 3/4 angles. They really captured Bale's squint. But the actual "spacing" between the eyes is slightly off, too wide...and you can see it at frontal views.
