Why not tell ebay now that you have received the item. However, it is not in the condition you were advertised. Return an empty box with delivery confirmation to a small store in the sellers zipcode. GET YOUR REFUND.Problem solved.....
Great idea but instead of an empty box, cat or dog turds would be a better box filler.

I sure hate to hear about scamming on Ebay, but if it exists it can be used for a scam. I enjoy Ebay but do advise caution, look at feedback first, ask questions if anything is unclear, and ask for clear pictures of the actual item for sale so a bait and switch is impossible. I rarely buy anything over $40 but if I do my spidey sense kicks into overdrive 
and I scrutinize everything about the auction: page design, amount of details and pics in the auction, feedback...positive as well, how long a member, the sellers Me page, even the location of the seller. And if anything seems weak I walk away, because their will always be more of what you want for sell, just be patient! There was a particular Star Wars card I wanted and it took me 3 years to find it at the price I wanted and from a seller that passed muster, and it sure felt great when the card arrived .

Guys, if you receive an empty box and that the scammer has proof of delivery the only way to get you refund is to file a complain right away.
Don't wait on paypal or anything.
Just go to the police.
Then when you have your copy of the complain contact paypal and tell them you received an empty box and you filled a complain with the police.
They will ask for a copy, they not look any further, and refund you.
I've returned a defective item to a seller and the box arrived empty.
I was not able to acces the web that week and couldnt respond to the seller mails.
He panicked and filed a complain.
He got his money back right away.
Finally when i got hold of him, i told him i shipped back with insurrance in case of anything happened (as i always do) and that i needed a copy of his complain to file a complain at my post office and get a refund.
He did send me a copy and i ended up getting a refund from the shipping insurrance.
Don't waste your time with paypal.

oh well, in my country, probably the police will ask me for money if i ask them to make a police report..
heck my store got robbed, and the robber got served tea and biscuit whereas my employee got scolded by the police for catching the robber..
so beating loopholes with loopholes is more suitable in my country..

I sold a figure to a stupid brazilian guy, he told me the tracking option was too expensive for him (it was LIKE 80 bucks) so stupid me, i send the item with no traking , after a month he files a dispute without even asking me anything saying he did not get the item1 and i'm pretty sure he did because i've never had any problems with canada post ! so I lost my $100 ! so that sucks!

i want to update members that understand this can happen to any one of us , and to all that think they are too cool for anything like this ever happening to them and think strippers love them , santa is real, and you can teach your father how to have sex PLEASE MOVE ON THE THE NEXT THREAD---
the only way to get around this scam is to open a (item not as described claim) the seller either responds or not in my case he did not, after 1 week as that is the time ebay gives the seller to respond ebay gave me a option to escalate the claim , advised me that they would get back with me in 72 hours, after that i got a email that they needed more time to make a decision after 2 more days i got a email from customer service to send the item back to seller, ebay provided me with the shipping label with tracking # with ups to use for return shipping, this seller sent me nothing and he will get nothing , i am though thinking about zip locking my cats litter in the box so he will get more than what i got, i want to thank member (hehateme) as he is the member that suggested this idea and i tell you again this is the only way to recoup from this scam.
i am sending the box with or without kitty poops monday and will provide a update

It sounds like he did it through ebay and not paypal. Ebay is significantly better with their buyer protection. Over the summer I had a package that was marked as delivered but I was home when the mailperson came. It was absolutely not delivered. I could prove it because she did deliver another package that day and it was delivered at a totally different time from the one that was lost. Long story short, ebay advised me to open a claim and then they determined neither the buyer or the seller was at fault and they refunded me out of their pocket. I was very pleased and very surprised!
Because of this, I believe ebay will help him.
I turned down a sale to a guy from brazil recently. He wanted me to mark a low value on the customs form to avoid taxes but I wouldn't do it as my insurance cover would be reduced to the low value I declared, plus he had zero feedback. However he seemed understanding.

final update--------ebay/paypal just refunded me, looks like the guy got away with the funds and ebay/paypal had to cover the loss,
if you want to recoup in a situation like this the only way is (read the thread) THANK YOU HEHATEME & the rest of members that know it can happen to any one of us and now we have a way to recoup and were very constructive in this matter----
as much as i wanted to mail the turd turds i would have broken mail laws so he got more than he sent me $1.00 ninja soldier from the $1.00 store------the rest that think you will be covered if you used cc or whatever---please do it your way---------
