Only available at Toys R Us, I saw one last week but I did not realize I did not have my dang debit card on me (took it out to buy gas and forgot to put it back in the wallet 
). So I was unable to pick it up went back next week and they were all gone, and they are now going for over 40 bucks plus on ebay. If anybody sees one at a TRU I will gladly buy him off of you and pay for shipping, I just do not want to pay scalper prices for something I could have gotten for 25 bucks just last week .
PS to avoid confusion it is the all black one on a yellow carded blister package with the gold Batman logo above the figure not the NES video game one in the black box.
