Have you sent him a C&D? That's always a good place to start. I'm not sure if you're wanting to get all legal on him put it would help any future situations that may arise.

And it's ridiculous that he's playing the "ignorance of the law" story. He knowingly downloaded a picture from the internet to use to promote himself and sell his autograph. No celebrity ever gives you a free print to have him sign it, they always sell the print and then sell you the autograph on top of that sale.

That's not true. I've gotten plenty of celebrity autographs and was only charged for the autograph. I was able to pick out any print I wanted. Now whether or not they factored the cost of the print into the autograph price is a different story.

Hi Eamon and I would like to start by saying that your She-Ra artwork, where she is looking over her shoulder is beautiful and is perhaps the nicest thing I saw while perusing your website today. I am emailing you today for a few reasons and the foremost was to compliment you on your excellent work. The second is to inquire why you went about this roundabout way to accuse me of stealing your work. Emailing me and pretending you wanted a print that I had decorated with at Power-Con rather than just asking me where I got the artwork and letting me know it was yours and you didn't want it copied. I was online when I ran into your picture and not noticing any copyright or any explanation who did this I made a print of it and took it with me to decorate my booth at Power-Con... as you know I was an animator on the show back in the 1980s. When I received your initial email I had no idea what you were talking about and then realized you must have seen the art at my booth, liked it and wanted one for your "girlfriend" as you said in the email. Being someone who likes to please fans of the show I went out and searched the web for the picture again, made a copy and sent it to you only to find that this was a planned trap to accuse me of selling your artwork as my own, which couldn't be further from the truth. At conventions many people come to me with toys, posters, prints and even fan art and DVD covers and want me to sign them. I did not create the toys, DVD covers or DVDs, I didn't draw the posters or fanart and I tell them that before I sign it but they want my autograph on them because I worked on a show they loved. I asked if you wanted the print autographed not to fake you into thinking I drew the picture but I thought that you and your girlfriend were simply fans of the show and I aimed to please. Months later I get an email from someone I met in Portland that they were a member of He-Man.org and that you were out there saying some pretty nasty and untrue things about me. I wanted to assure you that none of what you are saying is true and I would hope you could go out there and set the record straight. I do not make prints of your work available to the fans and if I did I would tell them who did the work and give them your website as a place to see more. I didn't do that because I wasn't aware of who did the artwork because I only saw the picture and not on a website. Safe to say that using it as a decoration at my booth brought many fans to my booth when they saw it because it is so stunningly beautiful, much more than the normal She-Ra picture ;)

Rather than hatching this devious plan to entrap me, all you had to do is email me directly and tell me you didn't want me to display your art and I would have complied without question because... I am not a thief and it seems you have somehow deduced I had evil intentions. I simply saw an uncopyrighted picture of a trademarked character that I thought would look beautiful decorating my booth.

Now, having explained all that to you I would hope you would go correct the record and slanderous things you said on He-man.org which affects my reputation. Also, now that I know who did the art I could post the picture at my booth and let people know your web address and perhaps drive some business your way (I only used it at Power-Con and I have been a guest at 8 different cons so far). I could also make better quality prints, with your permission, and sell them at the cons I attend and give you a percentage of the proceeds. I understand your anger and what you "thought" I was doing but please believe that I am a 61 year old nice fan pleasing guy that simply loved your work and was trying to make a fan happy... I wasn't trying to sell or claim the artwork as my own. Communication rather than accusation would have been a much better way to have addressed this situation. Sincerely, Tom Cook

He raised a couple of interesting points though. Is your work copyrighted Eamon? Also do you do He-Man & She-Ra art for profit yourself as I wonder how that works with a Trademarked character?
Still weird justification from him to rip you off though?
 
So really, Tongue Lashor is the one to be excited by there really?! Perhaps Gwildor.

I do not like NA She-Ra at all. Call it whatever you like but when I get a moment, i will draw up a proper NA She-Ra. What we got is a 200x ceremonial outfit and not something befitting the twins of the 'prophecy'. The one time they should look like twins, they don't.

I can't wait for Tung Lashor...he basically will be last figure I need to 100% walk away from the 2015 MOTU Classics Sub going further....anybody else I can just cherry pick for..

I am not a fan of Space She-ra either,but Scott said the POP sub would have a "variant" character or otherwise I'd go with Perfuma in place, except Mattel has not trademarked her and she needs to be renewed.NA She-ra is featured in the Mini-comic and I think Scott will push her into his Neitlich of the Universe

I have good word the $35 vintage figure is Mermista

Gwildor was recently trademarked and supposedly we are suppose to see 2 Movie figs in '14..

Lodar- travel figure Sub ex- Despara

Dragstor,Ninjor,Angella,Sssqueeze,Stridor,Night Stalker,Perfuma,peekablue,Saurod are NOT trademarked (yet) and their names are available.If I wanted,I could trademark them myself and I'd own the names.Since Scott says it takes 9-12 months to get a figure into your hands,if any of those figures are coming,they would need to be trademarked by now

Dylamug and Multi-bot have been recently trademarked ...so is Despara,Lodar.....interesting enough,Angella,Dragstor,and Ninjor still sit empty and are available

The work is mine. The guy stole and sold my work of a licensed character.
If folk couldn't draw licensed characters then you would not have things like artist ally and no artist anywhere would be able to draw Spiderman anywhere at any time ever. Unless you are selling mass copies of art of Spiderman drawn by you, you are fine.
Imagine what the art world would be like if folk were not allowed to draw any licensed character?
Whenever folks ask this kind of question I am always bit miffed by it.
 
If I am not mistaken folks are in fact not allowed to draw licenced character FOR profit purposes. But if I understood it correct, your image has not been sold by you and you havent kade any profit with it. So it is more or less a a fanart. I believe there is the difference between US and German law, because in Germany you are not even allowed to publish your art for free as long as it is not licenced. So all fanarts are technically ripoffs but as long as they are not sold they are tolerated. In US this seems to be not the case and allowed. Please correct me if I am wrong. :)

Unless you are an actual lawyer, sorry but I really don't care to hear yet another person tell me what they do and do not know about artists drawing licensed characters from legal standpoint.

It's kinda the wrong side to batting for in this isn't it?!
 
Morally I'm rather against copyright law as it currently stands, in the US at least. I'm for artist's rights but copyright doesn't really do all that much for artist's rights so much as it allows big corporations to badger artists. So I'd agree with Eamon that it's not cool to be arguing that an artist is just as in the wrong for illustrating a licensed character as someone who literally steals and sells copies of another individual's artwork.

You actually skirted my question about whether your He-Man art is sold for profit because effectively what your saying is you're (understandably) pissed that this guy has printed and sold your art for profit yet, you're (potentially) making profit from characters you didn't create too....

I've got a lot of respect for you though so this isn't an attack, just an innocent attempt to gain insight into the situation!
Like I said what the other guy has done, irrespective of the above, is well out of order. Especially deleting your sig off the artwork.

Does me making money from my He-Man art mean that what Tom Cook did was ok? I am side stepping for a reason.

Would you go ask Adam Hughs if he made money from his Wonder Woman con art after you heard it had been stolen? My guess is probably not as the issue is the stolen art and not weather the art was against DC copyright or how much money he got paid to do it.

I don't see how I have a big ego saying that either.

For the record, LEGALY, this is the breakdown as it was explained to me by my buddy who IS a copyrite lawyer.

An artist can draw whatever they like for profit. IF it's of an IP they don't own, the IP holder CAN issue a cease a desist about that one piece of art. THEN they can choose to persue legal action against the artist if they fail to comply.
GENERALY, most IP holders ( in thise instance, it would be Mattel) Will not do this, as they don't want to develop negative relationships with potential future clients. And just let sleeping dogs lie.

ALSO, this could be considered fan art, which is generaly covered by public domain.

SOME IP holders WILL go after artists, but it's generaly very rare.

ALTERNATIVELY, if it was a piece of art comissioned by the Original IP owner, then the artist might not be permitted to sell copies of the art.

but all in all, Eamon should be in the legal clear in selling any artwork he makes of MOTU characters for profit.



Back on topic, Cook is being a ****** for doing this.

The hood's there, it's just flat on his back (I think?) I'm hoping maybe he has alternate armor or something for a hood-up look? Either way, I think he looks awesome. Cool to have an old-school wizard-looking guy in the line.

Yeah, I think that's a safe guess. I'm a bit sad the mysterious book apparently will have nothing inside it! But other than that I am definitely looking forward to Eldor.

the problem is, you are not buying the print, you are buying the autograph , the whole things seems like you are fishing for credit, mopping around like you created sh-ra, didnt you try to take credit on something scott said about the motuc a while back, just cause you shot ideas on your postcast, sorry but if you dont want you ideas tooken you shouldnt air them out for people, and what ever happened to artists being happy someone actually likes their work, should of been an honor like he was flattering you, besides what he sold u is between him and you, i mean did u ask for that same print with an autograph from the con?
