Just how destroyed does it have to be? For them to send you a replacement you're providing them with a 'before' pic cleary showing damage. Therefore this damage warrants a pristine replacement since that's what you paid for in the first place.

I've been hoping for some time that SS would produce at least one McQ figure. If it had to be just one I'd prefer the Stormie since it's the most iconic in a general sense.
