All those retailer pre-orders would HAVE to have refunds or they would be in some big trouble.

I was think about that. If all those guys have already spent the deposits they had in order to purchase upcoming statues, and can't get refunds for these there is going to be a hell of a mess.
 
I'd imagine the restrictive wording was already in their agreement and XM was sent a friendly reminder.

I imagine it's going to take some time to get the funds back to all those people. This is going to be a mess.

Gents, why don't we wait to hear a formal announcement from XM before everyone goes and gives in to rumors. Unless someone can quote and name EXACTLY which retailers and whom said what, why speculate? It doesn't get us anywhere. :)

Simple Toys already sent out emails, I got one early this morning stating they can not ship outside of the restricted area and the only options were refund or find a local address to ship it to then have them ship it to you. If Simple Toys is doing this then it's only logical that the rest of the official retailers will follow suit soon.

The only thing we don't know is if this will affect Mark and the other Singapore members getting us statues. Or how this affect BBTS, Speculative Fiction or Secret Compass, I guess will find out in time.

I'm not sure why my post offended you when everyone in here is spectulating on what happened.

There are several post pages back with emails from ST stating orders will not be fulfilled. That's a fact or FACT, depending on how you want to take it.

Yes, an email from Simply Toys, not XM. Not offended just concerned about the damage the rumor mill could start to a great up and coming company like XM. It doesn't seem right to assume things until we know what is really going on.

Believe it. Woke up to the email from ST this mourning. Whether the rest follow suit I guess we'll see.

Mark...as Dan mentioned Simply Toys have already noticed customers who have XM orders but whose address is outside of XM's pre-defined sales territory. In that e-mail the Simply Toys rep specifically stated 1) they are unable to sell to customers outside of XM's sales territory 2) This announcement impacts all XM orders.

The e-mail also addresses the options for their customers which include transferring any deposits or requesting refunds. It seems highly unlikely that Simply Toys will be the only XM retailer impacted. Personally I am very doubtful that the company that complained to Marvel about XM violating their licensing agreement would be happy that only ONE major international retailer forfeited sales to the US and other international or domestic retailers would be allowed to sell to the US customers at their leisure.

I understand your concern about not wanting to spread unnecessary speculation...but let's be honest that is part of the fun of posting on this board. Nonetheless I think it is possible to have a business discussion if people acknowledge they may not have all the facts. Particularly if you are an individual who has real world experience with this subject matter.

Purely speculation on my part, but I believe the licensee who notified Marvel of this breech is going to want assurances from Marvel that going forward all XM retailers and distributors will be following the same mandate. If you are the licensee who paid for the exclusive rights to distribute 1/4 scale statues in the US...you do not want some other company receiving that same privilege for free.

If XM cannot handle some rumor mongering from a bunch of uptight, an@l retentive, statue geeks...they have absolutely no shot of any long term success. :wink1:

SimplyToys and Lil' Mosters (an EU distributor I believe) have both confirmed with in the last 24 hours that these restrictions are gong into place, as has Ben from XM to a member over at SF. Mark this is happening... It sucks, but it is what it is.
 
I thought it was already known that the US retailers, like bbts were out of the game as well.

BBTS stated some time ago that they would not be able to order any new statues, but we have heard nothing else from them, but I doubt they have avoided this.
