I ordered way back on 30th may. He said he gets his figures from a sideshow distributor.
I never had an idea this was unsafe otherwise I never would have done it. Do you think he will actually scam me like that?

Might as well give up. You are not going to see that money again and you won't be winning any cases if you file a claim. Best bet is to be nice to him and hope he delivers.

What I'm trying to figure out is why do people even preorder anything through ebay. It's still available on sideshow. Combine the rewards and coupon you might have saved $39 off msrp.

Beats me. I done some stupid **** but haven't pre ordered off ebay yet. :monkey3

that guy is the worst

Really...? like really, seriously..? how did you think giving someone huge amounts of money 6+ months in advance was a good idea...? on ebay/paypal where its a very well known, advertised fact that you have 30/45 days respectively to file claims...

I really struggle to wrap my mind around this stupidity...

Just because you know something, doesn't mean everyone does.. indeed 'stupid' is often someone who doesn't know something, which someone else found out last week.

I should not need to point out that some very experienced Collectors took a major haircut during the Mother's Basement debacle.. and quite a few experienced 'Grey Import' collectors, took a haircut, when ED-209 v2 turned out to have major QC problems.

..ain't none of us perfect.

The dilemma I'm faced with is to either take the risk of filing a dispute with my bank because it was linked to PayPal, and risk him finding out because he won't have enough funds for a chargeback.
Or take the risk that he will deliver on release date in 3 months time.

If you can get your money I'd go with that route. You already passed your buyer protection days so I'd use that for my last resort. Don't go flaming the buyer tho might piss him and get nothing.

May 30th? Ouch. You're Paypal window closed awhile ago so you might as well start collecting four leaf clovers at this point.

I'm about to order this guy, then IP, then maybe SC. I figured starting my 1st ironman with a diecast I will pass all the others plastics easily.

Ok, I guess I should try that without telling him.
I thought I would be ok because he lists preorders as auctions and other people have bid and purchased from him as well.
He still lists 2-3 pre-orders every month which is why I thought it was safe.

Talk to your bank first, however if your bank advise you there is no possibility of a refund, so long after the transaction.. then as RoCko says, there is no point in starting an argument with the Seller, if there is a slim chance the figures might get shipped.. but in future, do not use eBay for Pre-orders.

no, but I sure as hell research the **** out of something before I commit $$ to it. and if youre using ebay/paypal to buy these incredibly expensive figures, youd think you at least read over some of the protections they offer. Ebay and Paypal both make a huge effort to tell you You have 45 days to file a claim... even in you "purchased Items" at the day 40 mark it displays a warning to eaither leave feedback or if there was a problem to open a claim...

really no excuse

also no one just found out last week that buyer protection only lasts 45 days... its a well known fact

Buyer protection isn't really clear though because the seller put in his description that preorders are guaranteed.
It didn't even come to my mind that sellers could actually get away with this scam.

I just got scammed by showcasecomicsandstatues. I pre-ordered a falcon and a golden age cap from other ebay seller but they were nice enough to give me my money back. I just got off the phone with customer service with ebay and they said that they will try to get in contact with showcasecomicsandstatues and that in the mean time i should file a report on ic3.gov and see what they can do. I suggest that if anybody else that got scammed by this ebay seller or any other do this so we can get our money back and stop these guys from doing this again. Also learn from this. PM me if you have any questions.
