I believe it's legal as long as it's presented as a parody. It's the same thing that allows Family Guy or SNL to do spoofs with characters they don't own the rights to.

Bingo. The term "Superman" isn't trademarked by DC Comics or Warner Bros., the symbol though is which is why ol' blue eyes here doesn't have it. Either way the official title is Superman XXX which is how its catalogued avoiding the trademark lawyers just like the Batman XXX did.
