Obtaining likeness rights simply isn't a loophole that allows you to circumvent intellectual property and/or copyright law.
They're either advertising a project that will never come to pass (the actors in 2001 suits) or advertising the headsculpts in a very misleading way.
The old thread is still archived here and I got a lot of grief in it for stating the same thing but I was right then and odds are I'm still right. If you wanna make 2001 figures you need to clear it with the studio (not sure if it's MGM or Warner) and the Kubrick and Clarke estates on top of that.
