I'm not sure if anything has changed since I stopped buying comics, but Adam Hughes is freelance now.

I don't think the exclusive contract usually includes stuff outside comics, otherwise Jeph Loeb(exclusive to Marvel) couldn't work on the NBC show Heroes. So I don't think providing concept art for statues is that big a deal.
BTW, Adams main work for DC will be All Star Wonder Woman, I can't wait.
