^^^ I would have to counter and say people are expecting too little from Sideshow because they don't know it's their legal right. It's a company making a product. The company has collected payments from people and no one has even seen a finalized production piece. And everything photographed from toy shows is pure conjecture as to it's origins. Anyone who thinks the Attorney General will not investigate is sadly mistaken. I've done this before and it yields results.
 
And for those who need the legal language, here it is under the Fair Credit Billing Act, regarding "delays":

Delays

If the merchant is unable to ship within the promised time, it must notify you by mail, telephone, or email, give a revised shipping date and give you the chance to cancel for a full refund or accept the new shipping date. The merchant also must give you some way to exercise the cancellation option for free, for example, by supplying a prepaid reply card or staffing a toll-free telephone number.
•If you ignore the option notice, and the delay is 30 days or less, it's assumed that you accept the delay and are willing to wait for the merchandise.
•If you do not respond - and the delay is more than 30 days - the order must be canceled by the 30th day of the delay period and a full refund issued promptly.

If the merchant can't meet the revised shipping date, it must notify you again by mail, email or telephone and give you a new shipping date or cancel your order and give you a refund.
•The order will be canceled and a refund issued promptly unless you indicate by the revised shipping date that you are willing to wait.
•If you do not respond at all to the second notice, it's assumed that you are not willing to wait, and a full refund must be issued promptly.
 
Don't you think you're blowing this out of proportion? It isn't like the figure isn't going to come out, after they got our money. Then I could see bringing legal action in.

All I'm saying is if anyone wants to pull out, don't let Sideshow keep any of your money. They have no legal claim to it.

It's people's right to drop out, but it's either pay for this... or never ever own a 1/6 Snake :huh


I would like to have one too, but I'm beginning to wonder if that will ever happen. The customer service of this company is horrible. Someone inside this company should be accountable for how communications go out. But if no one ever complains and no one ever brings heat on them, they will only abuse it that much more.

I don't think there was a NRD on Snake, it needs to be a specific amount for them to keep some money. Like $300 or more?

This is their policy which will not hold up under the Fair Credit Billing Act...

FLEXPAY ITEM CANCELLATION FEES
Due to the increased administrative costs of the Flex Pay option, Sideshow will charge Flex Pay customers a cancellation fee when a flex pay order is canceled by the customer or by Sideshow (due to a credit card decline, incomplete shipping info, etc.).
Fee chart
The fee will be $20.00 for cancellations occurring 48 hours after order placement up until the first payment date, $40.00 for cancellations occurring after the first payment and before the second payment date, and $60.00 for cancellations occurring after the second payment and before the third payment date. (The fees are based on a average three payment plan of $199 or more, but fees may increase with number of payments.) If the item’s cost is less then $199, the cancellation fees will be reduced in proportion to the item’s SRP.
 
Sideshow has in the past waived the cancellation fee for Flex Pay customers when items have been delayed like this. Just contact customer support and ask for a full refund and explain that the reason is due to the delays. I think this is getting blown out of proportion. If you notice on the product page it says "Expected to ship December 2014". The key word there is "expected." It's an estimate, not a promise. Delays suck, but they are inevitable in this hobby.
 
Robocop was expected to ship by April of this year, after going up for order in May 2013 and only got shipped out by SSC a few weeks ago. Sure that's HT and not SSC, but you need to have some expectation that you're going to be in for delays if you're into this hobby. Again, it's not like this is never ever going to come out... it will.
 
Oh I've been collecting 1/6th scale for some time now. I'm not as rabid a fan as allot of people but I would say I have 25 to 30 Hot Toys figures and just as many Sideshow figures. I've seen my share of delays on many a figure, but the delivery on this one has poked me raw. They're clearly making it up as they go along now. If it won't be ready until March 2015, then say so. But don't rub my balls every month for half the year and say, "Not this month. Maybe next month". That gets right under my skin because they know they're lying to you when they say that. My point is, quite the freaking lying and make a date you can actually fill! If it gets here earlier then it's a bonus.
 
I would appreciate the whole "maybe next month" thing would stop, and they could give us a harder ballpark figure.

It's not a promised time... that's the thing, it's an estimate and generally the estimate is off. Now I don't know why it keeps getting crept back a month at a time, but delays are part of it. If they said it "it will be ready on such and such date" then I'd say you're right, but that's not how they do it.

I believe the threshold is $250 for a single item, or if you buy more than one.

Yeah, but you agree to that policy... so if you don't want to get hit with the fee you shouldn't have agreed to it in the first place. That seems more on the buyer to agree with a policy they don't like, rather than the company's fault. Not to mention, it seems a lot of retailer have either a NRD, or restocking fee if you cancel an order.

I would appreciate the whole "maybe next month" thing would stop, and they could give us a harder ballpark figure.

Agreed, but could be they are getting inaccurate messages from the factories or things outside of their control are at play. Either way, I haven't paid for anything yet and used a $20 off coupon on him, so I'm not sweating it :lol
 
Other SSC products have been getting delayed too right? There must be some manufacturing hiccup, it probably has nothing to do with SSC directly.

$250 for a NRD makes sense now, since there were a few I got that notice for that I ordered and I swore it was $300 for that.
 
Yeah, everything I had on order has been pushed back and quite a few of the HT figures have been delayed a month or so as well. I can't remember when I was original supposed to get Robocop, but I was thinking it was more like August or September. And he just arrived yesterday :lol
 
It's always good having multiple things coming throughout the year when you get delays like this happening. One would think I would be pissed over Snake, but I'm actually fine with it :lol

I've been buying way too much over the past year so more delays won't hurt.
