Buyer protection isn't really clear though because the seller put in his description that preorders are guaranteed. It didn't even come to my mind that sellers could actually get away with this scam.

Ok, I guess I should try that without telling him. I thought I would be ok because he lists preorders as auctions and other people have bid and purchased from him as well. He still lists 2-3 pre-orders every month which is why I thought it was safe.

The dilemma I'm faced with is to either take the risk of filing a dispute with my bank because it was linked to PayPal, and risk him finding out because he won't have enough funds for a chargeback. Or take the risk that he will deliver on release date in 3 months time.

I realise I'm a complete moron now but I didn't have a clue to be honest. Any advice is much appreciated guys. I'm at loss what to do.

I ordered way back on 30th may. He said he gets his figures from a sideshow distributor. I never had an idea this was unsafe otherwise I never would have done it. Do you think he will actually scam me like that?
