Possibly ripped off on ebay!

Mods, if this is in the wrong place, my apologies! I put it here cuz it pertains to a Sideshow Gambit PF. In any case, I purchased a preorder for Gambit on ebay for $260 shipped. It was a good deal in my mind, the guy had a 99.9% feedback rating with over 1200 deals. So, I have messaged him 3 times since the transaction and have received no response. Then, all of a sudden, when I check the page for the auction I won, there is a message that says ,

"The seller of this item is away until August 25, 2011. You may purchase this item, but there may be a delay in processing your order."

What the hell?!?! Ok, so now i'm a little worried that I got ripped off. The preorder says that the item should ship within 30 days of the auction and it hasn't been 30 days yet so I'm hoping I still receive the item. I'm hoping he ordered the gambit when I paid and it just gets shipped straight from sideshow so that the "away til 2011" won't matter. Does anyone know how these preorders work for dealers such as this guy? It seemed like he was pretty good dealer so I'm still hoping he either sends me the item or refunds me the money. If this does end badly, do I go through ebay or paypal to try and get my money back? I have never had to file a dispute so I'm not even sure how to go about it. Any advice or help would be appreciated!
 
File it through ebay, either way you are going to get your money back.
 
Launch a complaint with the resolution centre asap if there is no further response from him. If it goes past 30 days you won't be to get the refund. Did you use paypal? If you did the ebay resolution goes to paypal anyways. Even when you start the dispute they still give him a chance to respond. Good luck, hope you get your cash back or the item.
 
If you paid through Paypal, and your account is backed with a credit card. I would consider going straight to your credit card company.

I have had couple of issues with fraudulent sellers, I went straight to my credit card company and within 48 the amount was refunded to me.

i got my pf indy through ebay, as soon as i payed i got notice from ebay that the sellers acct and item was yanked due to negetive something or other and they wanted me to file for refund, i noticed when i payed it wasnt to seller but to cathys attic which i know to be a ebay selling store front, i gave a couple days and the item was at my door but if you havent heard anything i would file with ebay and with paypal as your protected as buyer for up to i think couple grand.

hope it all works out for you.
 
I pay deposit for pre order on eBay, this guy has his own web site , and with paypal, I am not that worry.
 
Well I sent the guy a message through eBay yesterday. If I don't hear back in a couple days, I will file a dispute. At that point it will be approx 18 days since I paid for the gambit. It can't hurt, if the item comes that's cool, if not and I get my money back that's cool too.
 
get your money back this is bs bro. we do this hobby for the love of collecting and these e-bay guys do it for profit, most of them anyway,and this guy is ripping you off this is just wrong. i hope you make out all right. i'm pulling for ya!:lecture
 
Maybe it's just a mistype and it meant 8/25/2010. I usually feel safe for someone who's had 1200 transactions with a 99% feedback score. Although, I've never done pre-orders on ebay. Just wait and let him know that you are concerned about the order and would like any type of response at this point. Hopefully, everything will work out for the best.

I had the EXACT same experience with an item I purchased from "Cathy's Attic" through ebay; the item (Aragorn PF Ex) arrived safe and sound a few days after the ebay advisory.
 
So, a couple info updates on this situation. I attempted to start a dispute through ebay but it told me to wait til sept 7th to see if the guy responds...i'm fine with that. Also, I messaged another guy who had recently received a refund on a gambit from the same seller and had posted a positive feedback on the seller's ebay account for a quick refund. He messaged me and he said the seller had a family emergency and would be out of town for a short while. This guy thought the seller accidentally put "2011" for when he would be back and that he would actually return in the next few days. According to him, the seller contacted him and refunded his money and said he was going to still process current orders when he got back. Although this is through a 3rd party, it made me feel much better about my situation. Hopefully, I hear from the seller soon!
 
Good for you,i never have any shame in trying to contact people that have purchased from someone on ebay if its a iffy situation.
